再给大家一个salmonfish打官司的案例。www.ddhw.com

一点说明，除个别细节稍加了一点儿润色以增加故事的趣味性（但绝无夸张）外，这个案例整个过程是真实的。其中人物以及对话基本属实（如果没有记错的话）。此案的涉案人是salmonfish本人。坦白地说吧，salmonfish她/他自己也知道确实违了规，她/他本应是输家，但在法庭上她/他有效地利用了司法程序和法律，保护了自己，反而变输家为不输。重要的是，她/他出了一口气。www.ddhw.com

在这里将此案献给脑友们主要有几个意图：（1）借此案了解一下西方司法制度的“公正性”；（2）脑友们以后如遇类似的情形，怎样遇急不乱（不要见了警察腿就软），知道如何利用你的权力来保护自己（也是我的主要目的）；（3）动动脑筋，娱乐娱乐。

我，salmonfish，经常要开着18 wheeler 从A 市送货到 B 市，途中不可避免地总要经过一段繁忙的市区路段。www.ddhw.com

一天早晨，大约 7：30，我的18 wheeler 夹杂在上班族的单向繁忙的车流中，也出现在这段拥挤的区间上。也许是昨晚刮大风的缘故吧，路边的许多树枝都被风吹断了，路面上有很多残枝落叶。所以，人们开车都格外小心，交通也特别缓慢。通常如果碰到了这种情况，我或是找一家咖啡店坐下来，优哉游哉一番，或是尽可能开到小路或支路上去，绕过咽喉地段。不巧的是这一段什么都没有，唯一的岔路是一个丁字路口，从早晨七点到九点还不许右转弯（老开这段路了嘛，什么不知道？！）。也只好捱了。好不容易捱到丁子路口跟前，交通几乎完全停顿了下来。百无聊赖，斜眼儿眇了一下路边的交通牌子。昨晚的风居然将挂牌子的杆子也刮歪了。也真是的，一根杆子上居然挂了八，九个不同的牌子。颜色不同且不说，有的牌子字还颓小，这也不许，那也不许，真够复杂的。要是在往常，车子开快了，任他是谁，眼睛再好都看不过来。www.ddhw.com

这时，停在丁字路口里面的一辆车，似乎等不及了，突然来了一个急转弯，拐到岔路上去了。紧接着，第二辆，第三辆车也跟了出去。再后面就是我的车了，走还是不走？一想，反正“法不治众”嘛，跟车走人，便尾随了过去。这边，我车子还没完全摆正（还没来得及得意呢），就听到后面警笛大作。然后，从后视镜里就看到一辆警车，闪着警灯，从相反方向也拐进这个岔路里来了。第一反应：完了，这下又该认罚了。匆忙将车停在路边，准备挨罚吧。www.ddhw.com

四辆违规的车这下全被警察给拦下来了，我的车是最后一个。因为我坐得高，警察处理前面的司机的戏都让我给看到了。第一辆车和第二辆车似乎是一拨的，司机也好像跟警察挺熟悉，寒暄了几句，警察微笑着一摆手，走人，两辆车都颠儿了。第三辆车可没那么走运。一个女司机，似乎还想给警察解释什么。警察理都没理，查了驾照，车保险，一张橘黄色的罚票递了过去。这女的也绝，不走了，等着，似乎还想看看我的命运是什么。有什么说的？违规了，罚就是了。不等警察来找我，我的驾照，保险本子都拿出来了，就等着挨罚了。警察也是，废话不多，公事公办。不一会儿，一张黄票也递了上来。这也就妥了。但也不知是怎么了，也许是鬼使神差吧，就在警察刚要离开时，我说了一句话：“Officer, the traffic sign has been blown down, you’d better to go to check it out.” 我发誓我是出于好心。不知道该警官是怎么理解的（还是下错床了？），显然是生气了，火爆的命令我“Get out。” 然后又咆哮：“Don’t tell me how to do my job, you XXXX,” “I’ve been here for last 16 years, and I have seen enough of these BS. ..blablabla.” 我能说什么呢？这不正是“碰上了拿枪的，有理说不清”嘛。“OK, OK, Officer ,  I got it” 我说道。心里那个窝火呀，一片好心被当成了驴肝肺。咳，也许警官是故意想做给前面的女司机看吧。是不是在说“看看，我对你还是客气的呢，不像对她/他，识趣的就拿着票走人吧”（杀鸡给猴看）。不管怎说，我作了一次冤大头。。。。www.ddhw.com

事后，看看罚票，也就才 $ 70.00.  但这X气实在让人咽不下。怎么办？上法庭。在法官（法律）面前谁怯谁呀。。。。。。

几个月以后的一天，法庭开庭，审理此案。警官和我都出了庭。www.ddhw.com

法官似乎认出了我, 咧了咧嘴角。谁惹得我老去麻烦他老人家呢？！（这大概是我第三次，或第四次站在他面前了吧）。法官先问了我有没有带律师。我说：“No, I don’t need a lawyer. But, Your Honor, may I pass this picture and the note to The Bench？”（一张照片和一张纸，上面只有一句话)。“You may”法官说道。一位法庭助理上前将材料呈现给了法官。www.ddhw.com

Two possibilities: 1. The policeman released the first two drivers without issuing any ticket to them, it is race discrimination. 2. The road sign changed from something like 6am to 9am because of the wind.

Yes, I could have challenged the police on why, and how he released the first two drivers without issuing ticket to them. Then I thought what kind of reply I could get during the hearing。Several possibilities: * simply deny it. www.ddhw.com * the first two drivers were police officers * local residents, they were getting back to their homes Any of these would have led this line to a dead end.   Race discrimination? It is a serious accusation , and I did't see any clear evidence getting me to there.   Experience:www.ddhw.com If you are going to a court, make sure that you are well prepared. Making a list of questions is a good start. However, you must carefully select the questions. Question you know does not lead you to where you want, don't use it. Question you know your opponent surely knows the answer, don't use it.
